WAIVER AND RELEASE OF LIABILITY
Showtime Basketball LLC & The Grove Community Collective
In consideration of being allowed to participate in, attend, and/or observe as a participant, parent, guardian, or spectator in any program, event, or activity (the “Programs”) organized, hosted, or operated by Showtime Basketball LLC and/or The Grove Community Collective, including any affiliated programs, leagues, camps, clinics, tournaments, teams, training sessions, strength and conditioning programs, youth development initiatives, or other sports-related events (collectively the “Providers”), consisting of sports, activities, and/or sporting events including but not limited to basketball training, games, camps, leagues, private training sessions, strength and conditioning, and related athletic activities (collectively the “Activities”), at any facility or location used for such Activities (the “Premises”), the undersigned participant, and the participant’s parent(s) or legal guardian(s) if the participant is a minor, agree to waive, release, and discharge the Providers and each of their respective owners, officers, directors, employees, contractors, volunteers, representatives, affiliates, successors, and assigns as follows:
CONSENT OF A MINOR
Any participant under the age of eighteen (18) must have a parent or legal guardian complete and sign this waiver and consent form on their behalf.
If a minor participates without the knowledge or consent of a parent or legal guardian, the parent or guardian should contact the Providers immediately. Parents or guardians may contact the Providers at any time to address, restrict, or remove any online profile, publicity, or personal information within the control of the Providers.
If a parent or participant experiences any challenge participating in youth programs offered by the Providers due to concerns regarding personal information or consent requirements, the parent or guardian should contact the Providers in writing with specific concerns or requests.
MEDICAL RELEASE
Pursuant to the provisions of Sections 6910 et seq. of the California Family Code, and other applicable laws, I hereby authorize the Providers to procure and consent to medical, hospital, or dental treatment for myself or my child in the event of injury or illness arising from participation in the Programs or Activities when a parent or guardian cannot be reached immediately.
I understand that I am responsible for any and all medical expenses incurred.
HEALTH AND COMMUNICABLE DISEASE ACKNOWLEDGEMENT
Participation in sports activities carries the risk of exposure to communicable diseases, including but not limited to COVID-19 or other illnesses. I understand that the Providers cannot guarantee that participants or spectators will not be exposed to such illnesses while on the Premises.
I voluntarily assume all risks related to exposure, infection, or spread of illness associated with participation in the Programs or Activities.
On behalf of myself and/or my minor child, I hereby release and waive any right to bring suit against the Providers and their owners, officers, directors, managers, employees, agents, volunteers, affiliates, or representatives (collectively the “Released Parties”) in connection with any illness, infection, injury, or damages related to exposure while participating in Programs or entering the Premises.
PHOTO AND VIDEO RELEASE
I grant permission to Showtime Basketball LLC and The Grove Community Collective to photograph and/or record video of myself or my child during participation in the Programs or Activities.
I authorize the Providers to use such photographs, video recordings, or other media for marketing, promotional, educational, or informational purposes, including but not limited to:
- Social media
- Websites
- Promotional materials
- Event coverage
- Program marketing
This permission is granted without compensation and shall remain in effect indefinitely unless revoked in writing prior to participation.
WEBSITE AND SOCIAL MEDIA RELEASE
I grant permission for the Providers to use my name or my child’s name, image, likeness, and related athletic content on websites, social media platforms, or other media channels in order to promote and showcase the Programs and Activities.
I understand that once media is shared online, it may be copied, reposted, or shared by third parties outside the control of the Providers. I waive any claims related to such use.
CONSENT TO PERSONAL INFORMATION
I acknowledge that the Providers may collect personal information for the purpose of:
- Program registration
- Communication regarding Programs
- Tracking participation and development
- Publishing athletic achievements or recognition related to participation
Such information may include names, photos, videos, performance metrics, or participation records.
If I do not consent to the publication of any personal information, name, image, likeness, or media content, I agree to notify the Providers in writing prior to participation.
WAIVER AND RELEASE OF LIABILITY
In consideration of participation in the Programs or Activities, or attendance at the Premises as a spectator or guardian, I hereby release, discharge, and covenant not to sue the Providers and all Released Parties from any and all present and future claims, demands, damages, actions, or causes of action resulting from:
- Personal injury
- Illness
- Death
- Property damage
- Medical expenses
Any other losses arising out of or connected with participation in the Programs or Activities.
I understand that participation in sports activities involves inherent risks, including but not limited to:
- Physical contact
- Falls or collisions
- Equipment failure
- Overexertion
- Serious injury or death
I voluntarily assume all risks associated with participation and accept full responsibility for any resulting injury or damage.
I further agree to indemnify and hold harmless the Providers and Released Parties from any claims arising from my participation or my child’s participation in the Programs or Activities.
This waiver is intended to be as broad and inclusive as permitted under the laws of the State of California. If any portion of this agreement is found to be invalid, the remainder shall remain in full force and effect.
UNKNOWN CLAIMS
The releases contained in this document are intended as a full and complete release of all liability of any nature whatsoever for all damages, injuries, losses, or expenses, whether known or unknown at the time of signing.
The undersigned expressly waives all rights under Section 1542 of the California Civil Code, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
GOVERNING LAW
This Waiver and Release of Liability shall be governed by the laws of the State of California.
Any legal action arising from this agreement shall be brought exclusively in the courts located in Santa Clara County, California.
This waiver shall remain in effect for all future participation in any Programs or Activities organized by the Providers unless revoked in writing.
ACKNOWLEDGEMENT
I certify that I have read this Waiver and Release of Liability in its entirety and fully understand its contents.
I understand that by signing this document, I am giving up substantial legal rights, including the right to sue.
I sign this agreement voluntarily.
